The arbitration shall take place in Westchester County, New York.

13.3 Class Action Waiver

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Westchester County, New York.
